“Applicable Law” means all the laws, rules, regulations, notifications, guidelines, ministerial decisions or cabinet resolutions in force and effect, as of the date hereof and which may be promulgated or brought into force and effect hereinafter in the United Arab Emirates, including judgments, decrees, injunctions, or orders of any court of record, as may be in force and effect during the subsistence of this Privacy Policy;
“Al Misk Properties” “we” “our” and “us” collectively mean Almisk Properties LLC;
“Al Misk Properties Terms and Conditions” means all of the terms, conditions and notices contained or referenced in Al Misk Properties’s Terms and Conditions and all other Al Misk Properties rules, policies available https://miskprops.com/ as amended from time to time;
“Data” means Personal Data and/or non-personal User’s data that is submitted, generated, featured and displayed through the Website, collected from the use of the Website and stored on Al Misk Properties’ servers;
“Legitimate Interest” means the interest of our business in conducting and managing our Website to enable us to give you the best service and the best and most secure experience. We consider and balance any potential impact on you and your rights before we process your Personal Data for our legitimate interests;

“User”, “you” and “your” collectively mean the person, company, or organization that has visited and/or is browsing and/or is using the Website in any capacity. A User may be, without limitation, a Customer, Real Estate Broker, Personnel, all or none of them.
2. Important information
2.1.Purpose of this Privacy Policy:
This Privacy Policy aims to give you information on how Al Misk Properties collects and processes your Personal Data through your use of the Website, including any Data you may provide through the Website and/or sign up to our newsletter.
Our Website is not intended for minors (persons under the age of 18) and we do not knowingly collect Data relating to minors. If you are a minor, you must have your parent or legal guardian read and agree to this Privacy Policy prior to you using or accessing the Website.
This Privacy Policy applies to your use of our Website, and all information we collect through our Website. By accessing and using the Website, you (i) agree irrevocably and without condition to this Privacy Policy, and (ii) consent to your Personal Data being collected, processed, used and shared in accordance with this Privacy Policy, and (iii) agree that we may provide notices to you on the terms and conditions set forth in this Privacy Policy and the Al Misk Properties Terms and Conditions.

3.1.What is Personal Data?
3.1.1 Depending on how you interact with our Website, we collect different kinds of information from or about you. We may collect, use, store and transfer different kinds of Personal Data about you which we have grouped together as follows:

b. Identity Data includes first name, last name, address, username or similar identifier, title and date of birth;

iv. your networks and connections made available to us, depending on the permissions you have granted, from your mobile and desktop devices' address book contacts, and other social media such as Facebook, Instagram and X.
3.1.2 We also get information about you and your activity outside the Website from our affiliates, advertisers, partners and other third parties we work with. For example, online advertisers or third parties share information with us to measure, report on or improve the performance of ads, or to figure out what kinds of ads to show you.
3.1.3 We also collect, use and share aggregated Data such as statistical or demographic Data for any purpose. 5.1 Information shared with everyone in the community: If you are a Real Estate Agent/Broker or Personnel, we may publicly share your Profile such as your name, photo, location and contact details, location, details of Property and any other information that you allow us to share. You can choose what personal information you provide as part of your Profile. We recommend that you guard your sensitive information.
5.2 Partners and other service providers: We may share your Personal Data with partners we work with, including our data hosting and data storage partners, chatbot providers, analytics and advertising providers, service providers that help us run our marketing and advertising campaigns, contests, special offers, or other events or activities and technology support and data security service providers. We may also share information with professional advisers, such as auditors, law firms, and accounting firms. We require all our partners to respect the security of Personal Data and to treat it in accordance with Applicable Law. We do not allow Partners or their Personnel to use your Personal Data for their own purposes and only permit them to process your Personal Data for specified purposes and in accordance with our instructions.
5.3 Information shared with our affiliates and group companies: We may share your Personal Data with our affiliates and group companies to understand how you engage with our products, to improve our Website, and to help us build a Website tailored to your preferences.

7.3. We have put in place procedures to deal with any suspected Personal Data breach and will notify you and any applicable regulator of a breach where we are legally required to do so under Applicable Law.

8. Data retention

To determine the appropriate retention period for Personal Data, we consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, and the applicable legal requirements. In some circumstances, we may anonymize your Personal Data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.
9. Transfers
9.1.The Personal Data that we collect from you may be transferred to, and stored at, a destination outside of the United Arab Emirates in accordance with the Applicable Law. By using the Website, you agree that your Personal Data may be transferred to, and stored at, a destination outside of the United Arab Emirates.
9.2. Your Personal Data may also be processed by staff operating outside the United Arab Emirates who work for us or for one of our partners. Your Personal Data may be transferred, stored, processed and used by our affiliated companies and/or non-affiliated partners in one or more countries outside the United Arab Emirates.

10.3.You will not have to pay a fee to access your Personal Data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.
10.4.We try to respond to all legitimate requests within [one month]. Occasionally it may take us longer if your request is particularly complex or you have made a number of requests. In this case, we will notify you.
10.5.We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Data (or to exercise any of your other rights). You will resolve any claim, cause of action or dispute (claim) you have with us arising out of or relating to this Privacy Policy exclusively before the [Courts of Sharjah].
